Section 03
No Absolute Uptime Guarantee
Unless a separate written service level agreement expressly provides otherwise, QIH does not guarantee 100% uptime, continuous availability or uninterrupted access.
- Servers may require maintenance, updates, restarts or security patches
- Data centres, networks, DNS providers or upstream providers may experience outages
- Websites may be affected by plugin conflicts, theme errors, database problems or excessive traffic
- Cyberattacks, DDoS activity, brute-force attempts or malware may disrupt service
- Temporary downtime does not automatically entitle the client to compensation or refund
Any uptime estimate, performance target or hosting expectation is provided for operational guidance only and shall not be treated as a legally binding uptime guarantee unless expressly stated in a signed written SLA.
Section 04
Third-Party Infrastructure Dependency
Hosting services may depend on third-party providers, including cloud platforms, domain registrars, DNS providers, email providers, CDN networks, payment gateways, plugin developers and software vendors.

Malware, phishing, botnets, DDoS tools, credential theft, unauthorised scanning or hacking activity is prohibited.

Excessive CPU, RAM, storage, bandwidth, crawling, scraping or automated load may be restricted.
IP & Copyright
Copyright infringement, trademark abuse, pirated software or unauthorised media hosting is prohibited.
Compliance Risk
Sanctions evasion, financial crime, fraud, fake identities or restricted activities are prohibited.
Section 07
Security Measures and Limitations
QIH may apply commercially reasonable security measures, but no hosting environment can be guaranteed to be completely secure.
- SSL/TLS configuration may be provided where technically available
- Firewall, CDN, malware monitoring or security plugins may be used where appropriate
- Server updates and security patches may be applied where operationally necessary
- Client-side weak passwords, shared access or compromised devices may still create risk
- QIH does not guarantee complete protection against hacking, malware, phishing, data breach or unauthorised access
Security hardening reduces risk but does not eliminate risk. The client remains responsible for account hygiene, access control, staff behaviour, password security, plugin choices and lawful website operation.
Section 08
Backups and Data Recovery
QIH may offer backup support depending on the hosting package, server configuration and third-party tools used.
- Backups may be daily, weekly, manual, automated or package-dependent
- Backups may fail, become corrupted, incomplete or unavailable
- Restoration may require technical time and may not restore every setting, order, file or database entry
- Clients are encouraged to maintain independent backups of critical data
- QIH is not liable for data loss where the client failed to maintain independent backups or where loss results from third-party failure, client action, malware or force majeure
Section 09
Website Migration and Technical Transfer
Website migration, server transfer, domain connection or hosting transfer may involve technical risk.
- Migrations may cause temporary downtime, broken links, file issues or configuration conflicts
- Old hosting providers, registrars or plugin licences may restrict access or transfer
- Some websites may contain outdated code, incompatible plugins or corrupted databases
- QIH does not guarantee that every legacy issue can be fixed during migration
- Migration timelines depend on access, website size, server condition, DNS propagation and third-party cooperation
Section 10
Domains, DNS and SSL
Domain registration, DNS settings, nameservers, SSL certificates and domain ownership may depend on third-party registrars and certificate authorities.
- Clients are responsible for maintaining ownership and renewal of their domain names unless otherwise agreed
- DNS propagation may take time and may temporarily affect website or email access
- Incorrect DNS settings may cause website, email or SSL problems
- SSL certificates may fail due to DNS errors, domain validation issues or certificate authority restrictions
- QIH is not liable for domain expiry, registrar suspension, incorrect client-side DNS changes or domain ownership disputes
Section 11
Email Hosting and Deliverability
Email hosting, SMTP configuration, DNS authentication, SPF, DKIM, DMARC and deliverability support may be provided where included in the service.
- QIH does not guarantee inbox placement, zero spam filtering or uninterrupted email delivery
- Email deliverability depends on DNS records, sender reputation, content quality and recipient mail servers
- Spam, bulk mail or abusive email activity may result in suspension
- Third-party email providers may restrict accounts, sending limits or authentication methods
- Clients remain responsible for lawful email marketing, consent, unsubscribe processes and anti-spam compliance
Section 12
Software, Plugins and Licensing
Websites may use WordPress, WooCommerce, themes, plugins, page builders, scripts, APIs and third-party software.
- Clients are responsible for maintaining valid licences for premium plugins, themes and software unless included in the package
- Plugin conflicts, outdated code or unsupported software may cause errors
- Third-party developers may change features, pricing or compatibility
- QIH may refuse to install unsafe, pirated, nulled or suspicious software
- QIH is not liable for failures caused by third-party software, unlicensed plugins or client-installed tools
Section 13
Resource Limits and Fair Usage
Hosting services may be subject to storage, bandwidth, CPU, RAM, database, email, file count, visitor or process limits.
- Excessive usage may require package upgrade, optimisation or migration to dedicated resources
- High traffic, bots, crawlers or attacks may trigger temporary restrictions
- QIH may throttle, suspend or isolate accounts that threaten server stability
- Large media files, backups, logs or unused data may need removal
- Fair usage rules may apply even where a package is described as generous or scalable
Section 14
Payment, Renewal and Suspension
Hosting services may be billed monthly, annually, project-based, prepaid or subscription-based depending on the package.
- Hosting fees must be paid on time to maintain service continuity
- Late payment may result in suspension, data access restriction or service termination
- Reactivation after suspension may require payment of outstanding fees and administrative costs
- Third-party costs, domain renewals, licence fees, SSL fees and premium tools may be billed separately
- Chargebacks or payment disputes may result in immediate suspension of hosting services
QIH is not responsible for website downtime, email interruption, data access issues or business loss caused by unpaid invoices, failed payments, chargebacks, expired subscriptions or client refusal to pay required renewal fees.
Section 15
Cancellation and Data Removal
Clients may cancel hosting services according to the applicable service agreement, subscription terms or written cancellation rules.
- Cancellation must be submitted through an approved communication channel
- Setup fees, completed work, third-party costs and prepaid services may be non-refundable where legally permitted
- Data may be deleted after cancellation, expiry, non-payment or service termination
- Clients must request migration or backup export before cancellation where they require a copy
- QIH is not required to store client data indefinitely after hosting termination
Section 16
Emergency Suspension and Security Intervention
QIH may suspend, restrict, isolate or modify hosting services without prior notice where necessary to protect infrastructure, clients, users, third parties or legal compliance.
- Malware infection, phishing, spam, DDoS activity or abuse complaint
- Excessive resource usage affecting server stability
- Legal notice, copyright complaint, law enforcement request or provider warning
- Sanctions, fraud, AML, restricted activity or compliance concern
- Compromised account, exposed credentials or unauthorised access risk
Emergency suspension or restriction carried out for security, compliance or infrastructure protection does not constitute breach of contract by QIH and does not automatically create refund or compensation rights.
Section 17
Content and Legal Responsibility
The client is fully responsible for all content, products, claims, media, data, code, customer information and activity hosted through their website or account.
- Clients must ensure their website content is lawful and does not infringe third-party rights
- Clients are responsible for privacy notices, cookie banners, terms, refund policies and consumer disclosures
- Clients are responsible for product legality, advertising claims and regulated content
- Clients must not use hosting services for unlawful surveillance, hacking, fraud or deceptive activity
- QIH may remove or restrict content where legal, platform, provider or compliance risk arises
Section 18

Hosting services support technical availability but do not guarantee business performance.
- Hosting does not guarantee Google ranking, SEO growth or organic traffic
- Hosting does not guarantee sales, leads, conversions or revenue
- Hosting does not guarantee advertising approval or marketplace acceptance
- Hosting does not guarantee website speed scores where themes, plugins, images or third-party scripts are poorly optimised
- Business outcomes remain the responsibility of the client
Section 19
Force Majeure
QIH is not liable for hosting failures, delays or interruptions caused by events outside its reasonable control.
- Data centre outages, internet backbone failures or upstream network problems

- QIH is not liable for loss of profit, revenue, opportunity, goodwill, search rankings, customers or business continuity
- QIH is not liable for data loss, downtime, email delivery failure or security incidents outside its reasonable control
- QIH is not liable for third-party provider outages, domain expiry, plugin failure, software conflicts or client-side errors
- QIH is not liable for losses caused by client misuse, unpaid invoices, weak passwords or failure to maintain independent backups
- QIH’s total liability shall not exceed the hosting fees paid for the specific affected service period, unless mandatory law requires otherwise
Nothing in these terms excludes liability that cannot legally be excluded under applicable law, including liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence where such exclusion is prohibited by law.
